Titel: Specialist Showcases for the new Museum Galleries at Natural History Museum of Denmark
Beskrivelse: The National History Museum of Denmark ("NHMD") has conducted a procurement procedure regarding a contract for P1: Specialist Showcases for the new Museum Galleries at the Natural History Museum of Denmark. The contract concerns the design, manufacturing, engineering and on-site installation of 173 specialist showcases for the new museum galleries, including lighting, graphics, fittings and - as an option - bespoke mounts. The contract includes an option to leave out the manufacturing, engineering and on-site installation of up to 33 showcases (and the included lighting, graphics, fittings and possibly bespoke mounts related to the specific showcase) from the contract. The NHMD has decided to make use of this option and have left out some of the showcases from the contract. Furthermore, the contract includes the contractor’s performance of variants to the extent NHMD finds it necessary to complete the museum galleries in accordance with the gallery designs.

Hovedpunkterne i proceduren: The procurement procedure was carried out as a negotiated procedure with prior call for competition pursuant to section 61-66 of the Danish Public Procurement Act. The procurement procedure was carried out in two phases: • The prequalification phase • The tender phase The NHMD intended to select three to five candidates. The NHMD selected five candidates. Only candidates who had been selected by the NHMD during the prequalification phase was invited to submit an initial tender in the tender phase. The NHMD invited all tenderers to a site visit at the Natural History Museum of Denmark. The NHMD expected to award the contract based on the initial tenders (i.e. no negotiations are conducted), but reserved the right to conduct one or more round(s) of negotiations if necessary. The NHMD decided to award the contract based on the initial tenders received, i.e. no negotiations were conducted. The NHMD awarded the contract to the most economically advantageous tender based on the criteria ‘best price-quality ratio’. Candidates were excluded from participating in the procurement procedure if they were subject to one or more of the grounds for exclusion in sections 134(a) and 135-136 of the Danish Public Procurement Act. Furthermore, candidates were excluded from participating in the procurement procedure if the candidate (including other participants in an association, consortium or similar) was covered by article 5k of Regulation (EU) No 833/2014. The NHMD has obtained sufficient documentation for the information in the winning tenderer's ESPD.

Beskrivelse af optioner: The contract includes the following options: (i) An option to leave out the manufacturing, engineering and on-site installation of up to 33 specialist showcases (and the including lighting, graphics, fittings and possibly bespoke mounts related to the specific showcase). The NHMD may exercise the option to leave out one or more of the showcases no later than the date of conclusion of the Contract. (ii) Options regarding manufacturing, engineering and on-site installation of bespoke mounts based on the unit prices set out in the Pricing Schedule. The NHMD may exercise the option and the Contractor is obligated to deliver the services covered by the option upon remuneration in accordance with the Pricing Schedule when the NHMD demands this. The NHMD may exercise the option up to 2 months after the conclusion of the Contract.

Oplysninger om klagefrister: The Danish Complaints Board for Public Procurement Act (Act no. 593 of 02.06.2016 which is available at www.retsinformation.dk.) contain the regulation governing the deadlines for review procedures regarding public procurement under Danish law. Complaints must be lodged with the Complaints Board within a 45 calendar day deadline initiated by the NHMD's publication of this contract award notice in the Official Journal of the European Union. The first day of the deadline is the day following the publication date, cf. section 7(2)(i) of the Danish Complaints Board for Public Procurement Act. The complainant must notify the NHMD of the complaint in writing at the latest at the same time as the complainant lodges the complaint with the Complaints Board. Furthermore, the complainant must inform the NHMD as to whether or not the complaint has been lodged in the standstill-period and whether the complainant has requested the complaint to be given suspensory effect, cf. section 6(4) of the Danish Complaints Board for Public Procurement Act. To lodge a complaint with the Danish Complaints Board for Public Procurement the complainant must pay a fee of DKK 20,000.
